Statement


San Francisco (March 26, 2010) – An agreement has been reached with the previous America’s Cup Trustee, Société Nautique de Genève, that all outstanding litigation in the New York courts concerning the recent 33rd match will be dropped by both sides.

This includes GGYC’s Breach of Fiduciary Duty (“BFD”) claim against SNG, as well as all other claims over the design and construction of yachts Alinghi 5 and USA.

GGYC’s yacht USA won the 33rd Match on February 14 off Valencia, Spain.

“In place of controversy, we seek consensus. Instead of continuing argument, we are pleased to have reached agreement,” said GGYC Commodore Marcus Young.

GGYC’s representatives have started a consultative process with regard to the venue, timing, format and type of boat for the 34th America’s Cup.
GGYC and the Challenger of Record, Club Nautico di Roma and its sailing team Mascalzone Latino headed by Vincenzo Onorato, are cooperating closely in this.

“Good decisions not hasty decisions – this is what the Cup community wants,” added Russell Coutts, CEO of GGYC’s sailing team BMW ORACLE Racing. “Our focus is on looking ahead and making the 34th edition of the oldest trophy in international sports the best America’s Cup yet.”
Discussions will continue over the next six months with the details of the 34th Cup confirmed during 2010.

“We will do our best to fulfill Larry Ellison’s vision of a competition which respects the Cup’s unique tradition whilst moving forward with the latest technology to attract an even wider audience,” commented Coutts.

The America\'s Cup trophy is returning to New Zealand, where it will be on display for public viewing during the Louis Vuitton Trophy regatta in Auckland.



The Cup, which was won one month ago by the American team BMW ORACLE Racing, has been residing in its new home at the Golden Gate Yacht Club in San Francisco. It is scheduled to arrive in Auckland on Tuesday, March 16th.



This will be a homecoming of sorts for the America’s Cup, which spent nearly eight years in the trophy room at the Royal New Zealand Yacht Squadron following Team New Zealand’s victory in 1995.



The skipper of that team, Russell Coutts, is the CEO of BMW ORACLE Racing.



“It’s appropriate that we bring the trophy to Auckland this week,” Coutts said. “Most of the America’s Cup community is in town, including Mascalzone Latino, the team for our Challenger of Record, racing in the Louis Vuitton Trophy. So although we weren’t able to compete in this regatta, we wanted to support the event.



“We’ve been here for a few days already, consulting with the teams about the next edition of the America’s Cup. Bringing the Cup back to New Zealand now, during this regatta, will help to get everyone excited and focussed on what happens next.”



The Louis Vuitton Trophy events are the result of a partnership between Louis Vuitton and the World Sailing Teams Association, designed to provide regular, high-level match race regattas in large and complex racing yachts.



“It’s great to have BMW ORACLE Racing, one of the founding members of the WSTA, showing their support for the other teams by bringing the ‘Auld Mug’ back to New Zealand,” said Bruno Troublé, spokesperson for the WSTA.



“By supporting this event, BMW ORACLE Racing is also paying tribute to Louis Vuitton, which has contributed to growing the America’s Cup so much over the last 27 years, all the while respecting its values, tradition and history.



“While the details of the next edition of the Cup are being worked out, the Louis Vuitton Trophy regattas are a great proving ground for the teams.”



Eight teams are currently racing in Auckland for the Louis Vuitton Trophy. Further events on the calendar include regattas in La Maddalena, Italy, Dubai and Hong Kong.



The America’s Cup will be available for public viewing at Voyager, the New Zealand Maritime Museum, at the Viaduct Harbour, on Tuesday, Wednesday and Thursday of this week from 1100 until 1600 (1530 on Thursday). The Museum is putting on special rates of just $5 per adult, with free admission for children 14 and under.

Today\'s press conference of BMW Oracle Racing, the new Defender of the America\'s Cup, concludes the 33rd edition of the Cup and opens the 34th.



Russell Coutts, skipper of Larry Ellison\'s team BMW Oracle Racing, confirmed today that Golden Gate Yacht Club has accepted the challenge from Club Nautico di Roma represented by Mascalzone Latino Audi Team. The team chaired by Lara Ciribi Onorato is the new Challenger of Record for the 34th America\'s Cup. Her husband, Vincenzo, an experienced sailor, who has led Mascalzone Latino in the two previous America\'s Cup campaigns stated, “Thanks, Larry, thanks, Russell. I will pursue this role with honesty, passion, and friendship.”



The Challenger of Record has the task of negotiating with the Defender the terms of the future competition which will be based on mutual consent, as reiterated by Russell Coutts. The purpose is to offer the America\'s Cup a future as a great sporting event based on fair rules, agreed upon by all participating teams.

"Thank God, this is the end of a long night for Oracle". These were the first words of Vincenzo Onorato in Valencia, moments after the American trimaran crossed the finish line and won the 33rd America\'s Cup.



Lara Ciribì Onorato, newly nominated President of Mascalzone Latino Team Audi, echoed Onorato\'s words from Italy: "This American victory comes after a long dispute that lasted almost 3 years. We at Mascalzone Latino are proud to have supported the positions of Larry Ellison and Russell Coutts right from the start. Thanks to this victory, the America\'s Cup will become a high profile sporting event, run by fairer rules than the ones the previous Defender wanted to impose".

"The Court of Appeal judgment, in simple and essential terms, has saved the tradition of the Cup and set aside rules that were unacceptable; this was the primary purpose of this legal action, and has been achieved. In any event, I believe that the Cup has benefited from this: reaffirming the fundamental principle upon which the event is based may bring a healthy change; an exceptional sporting event pitting two giants of the sea against each other will keep everyone’s attention on the Cup. And this happens at a time when, realistically, it would not have been easy to find sufficient resources to adequately prepare a multi-challengers event. As legal counsel, I assisted Mascalzone Latino by intervening in the legal action before the New York Court though an amicus brief, in support of BMW-Oracle, sharing in full the rationale of the action brought against Alinghi and its plan to turn the America’s Cup into an event managed unilaterally by the defender, without reserving any role to the challengers".

I am happy for Oracle\'s victory.I would like to remind everyone that Mr. Bertarelli was the one who excluded Russel Coutts from the last edition of the America\'s Cup: the greatest race in the world without the greatest yachtsman of all time!Get lost Alinghi and the same goes to all those teams of cunning professionals who hypocritically supported him until now.  The boat race returns to the water, as the judges of the Supreme Court of New York   have written and sanctioned. We will live the super match of the third millennium among the two  "trima-monsters" of Oracle and Alinghi in a showdown at the OK Corral.

I have read the list of the last - minute registered teams to Your America\'s Cup.



You would forgive my insolence, but in such a very short  time a number of teams without history or "art" have been promptly and immediately  accredited to the highest world sailing competition. These teams "by chance" have filed an Amicus brief against GGYC – BMW Oracle Racing team. The above would be nearly – and I repeat nearly -  marginal if you would have not taken more then an year to issue a confirmation letter of acceptance of our Club and Mascalzone Latino! You asked for the  proof of the existence of Reale Yacht Club Canottieri Savoia which has more then a century of history and participations into two America\'s Cup.



The matter raises existential questions: which rooms near the sea  I have visited in the last decades in Naples? Where I have had dinners hundreds of times thinking to be my yacht club? Should I now question whether my club exists? I\' m proud of my Neapolitan origins . You Mr Bertarelli , you should be ashamed to offend my club and the city it represents only because we have supported Oracle arguments. You could make other  amicus brief being signed by teams which from the America\'s Cup expect anything but a loyal competition; the so called "professional" of sailing which means those who wish to make money from sailing, have  not always honoured our sport, too eager for money and not for the competition. Congratulation to Russell who has the courage to give up with you, and to Ellison to defend our sport. A pray: for once please reply to me, and do not hide you behind your "rubber wall"  which does not honour you .

If someone still has any doubt on the legitimacy of the Oracle case, that we support, I have to report the last updating of our position

If someone still has any doubt on the legitimacy of the Oracle case, that we support, I have to report the last updating of our position, how Mascalzone Latino is a team that hasn’t been clearly recognized as challenging yet, notwithstanding we have met the protocol’s indications since a long time.



Alinghi-S.N.G. still asks us information to prove the existence of the Royal Yacht Club Canottieri Savoia and the affiliation to the Italian Sailing Federation (FIV). I would like to remind Mr. Bertarelli & Co. that my club has more than a hundred years of history, moreover it has already taken part in two editions of the America’s Cup.



A history a little bit sounder, please allow me to speak ironically, than the ghost yacht club he proposed as Challenge of Record. Anyway an attitude proving the Defender’s arrogance. An unacceptable intimidation that offends not only my team, but also the city I represent in the Cup.

RYCCS – Mascalzone Latino – AC 33 registration



Reale Yacht Club Canottieri Savoia and Mascalzone Latino asked me to reply to your recent e-mails in which you have requested further documents concerning the establishment of the Yacht Club (Certification of Incorporation, Trade Association registry act, affiliation to Federazione Italiana Vela) in order to “validate” their challenge Entry.



This request , which is made more then a year later from the registration to the America’s Cup 33rd , is illegitimate and arbitrary.



RYCCS and the team have fulfilled the requirements to entry into 33rd America’s Cup since November 20th ,2007. This included the “notarized and certified” copy of Yacht Club incorporation, the by laws , and documents concerning its regattas, as required by the Notice of Entry. In addition, we remind you that this challenge is among the few that has paid the entry fee accompanying the Notice of Entry (It has been in fact public that some of the other teams entered in 2007 were relieved from paying such fee).



Further it is public knowledge that Reale Yacht Club Canottieri Savoia is amongst the most well known and active yacht clubs nationally and internationally, organizer of prestigious regattas and with two America’s Cup participations, as you are well aware. This Yacht Club has its origin back into 1893 with more then a century’s history.



RYCCS is a duly registered 33rd America’s Cup challenge, as also recognised by a number of correspondence from ACM and Alinghi team. Now the team is also, finally, listed in the America’s Cup web site. RYCCS/Mascalzone Latino is among the 33rd America’s Cup accepted challengers, only subject, as well as the others, to the outcome of the New York State Court of Appeals’ decision.



There is no basis for a “validation” procedure , which is not even set forth within the current rules. It is therefore groundless and discriminatory to enquire for further documentation of a Yacht Club which is well established and operative.



In addition this enquiry is unduly delaying the procedure for obtaining the fiscal benefits by the Spanish authority, in accordance with the Royal Decree n°1893/2008, which procedure could only be completed by receiving a letter from you certifying the challenge registration.



We trust that the position of RYCCS is clarified and please forward us the due letter of

registration which the Spanish Authorities are requiring.
